Making the most of native title in Australia:
achieving outcomes and managing benefits

Abstract

This seminar will acquaint the audience with the current state of play in native title policy, practice and law in native title in Australia. The slow progress toward the resolution of outstanding claims is contrasted with the growth in agreement making, further fuelled by the mineral resources boom. The seminar will place specific focus on one of the critical issues in the management of agreements and settlements, that is, the planning for implementation and the structuring of benefit packages. The use and construction of trusts, taxation of native title payments and the distribution of benefits emerge as key themes.
